This unit examines not only the law which protects investors in management investment schemes but also the regulation of those in the managed investment industry. Principal topics covered include objectives of financial regulation; background to the Australian managed investments industry; regulatory framework of managed investments (viz. chapters 5C, 6D, 7 of Corporations Act); the role played by non-statutory regulation and state laws; investor protection under general law (viz. accessory liability, tracing remedies, deceit, negligent advice, conversion, money had and received), and investor protection under criminal law (viz. conspiracy, confiscation of assets, money laundering). -- Course Website
