This unit examines the process of appointing a receiver and manager out of court under an express power in a mortgage or mortgage debenture. The mode, validity and effect of the appointment are analysed. The powers, duties and liabilities of the appointee form a major part of the unit. Other topics covered include the receiver's remuneration and indemnity; the interaction of receivership with winding up and voluntary administration, and receivership in private international law.
