This unit aims to introduce students to the law and practice of international commercial mediation. It explores the international regulatory framework of mediation from the perspective of Australian parties engaging in cross-border dispute resolution using the mediation process. Students examine a series of cross-border regulatory instruments on mediation—the UNCITRAL Model Law on International Commercial Conciliation, the EU Directive on Mediation in Civil and Commercial Matters and the US Uniform Mediation Act.
