This unit is a study of the various matters which are likely to arise in action based on s.52 of the Commonwealth of Australia Trade Practices Act 1974 and the corresponding provisions of the Fair Trading Act of the various states. Matters which are analysed include the judicial construction of the phrase 'misleading and deceptive conduct'; parties to a misleading and deceptive conduct claim; causation and remoteness in actions based on the breach of s.52; damages and other remedies and the limitation period. -- Course Website
