This unit examines native title law from three main perspectives. First, it considers the policy environment which led to the enactment of the Native Title Act in 1993, and its subsequent history. Second it considers the detailed operation of the legislative framework and the role of the Native Title Tribunal in particular. Thirdly, it considers the practical operation of this regime and the negotiation of native title agreements under its auspices. This includes the requirements to establish a native title claim and the relationship between Commonwealth and State law in this field. -- Course Website
